Collection of Personal Information/Data:

When you create an TPRT profile or account, purchase a product or service, register for a bundled service/promo with us, connect to our services, contact us including by social media or participate in an online survey, we may collect a variety of information, including your name – legal and assumed, mailing and/or residence address, phone number, email address/es, contact preferences, device identifiers, IP address, location information, travel information and preference/s both in the past and intended, and other profile information including posts and entries where the contact is via social media.

By signing up for a member account using your social media  or google account, the Site collects information that automatically populates member information to facilitate the use of the Site.

By visiting our Site, we may collect usage information automatically, such as your IP address, geographic data, country, search preferences, browser and information about your device’s operating system, pages that have been shown to you, the origin (ad, social media post, page, email) that led you to our Site.

When you share your content with family and friends using Hello PH! products and services, send gift certificates and service vouchers, or invite others to participate in Hello PH! services or visit the pages of our Site, Hello PH! may collect the information you provide about those people such as name, mailing address, email address, and phone number. Hello PH! will use such information to fulfill your requests, provide the relevant product or services, or for anti-fraud purposes.

To facilitate and successfully service your requests, purchases, booking of travel dates, and managing reservations for travel accommodations, ground and sea transportation, booking airfare, day activites, meals, other tourism services, purchasing travel products, or as required by law, we may ask for information such as but not limited to a government issued ID, passport information, age, birthday, gender, country of residence, address, email, mobile number, location, accommodation, length of stay, itinerary of your travel, flight information,

When there are other members in your group who are part of your booking, if you are booking for someone else, or if you are booking a gift for someone else, it is your responsibility to provide the correct information of your guests or beneficiary and that you have made them aware of sharing their personal information; and they understand and agree to how their information is used.

In some cases, other personal or sensitive information like religion and health condition will be asked for the limited reasons of health, safety, and special conditions such as food allergies, religious dietary restrictions, capacity to perform activities (such as hiking, SCUBA, water activities, amusement rides), or as part of the process of cancellation or refund due to a health reason that a third party provider of service may request.

In regards to the new environment of health and safety policies revolving around Covid-19, we may ask for additional information such as health conditions, travel history, contact history, and test results for Covid-19 that may be requested by our providers of travel and tourism services, local government units (LGU), government agencies, or by law to successfully facilitate your requests, bookings, managing your reservation and travel; and when applicable, to contact you after your travel dates and services have been performed.      

When you contact us via the multiple forms in our Site, email, mobile number, VOIP, social media accounts, we may collect your personal information to perform your request, purchase, manage your booking, for anti-fraud, anti-money laundering, regulatory policy, or required by law.

Credit Card Information

Hello PH! does not collect credit card information. All payment processing with the use of credit cards and collection of credit card information are performed by Third Party Payment Service Providers such as but not limited to PayPal, Payoneer, and PayMaya.

Upon check out and payment for services and products on our Site, you may choose which Third Party Service Provider of credit card processing you are most comfortable to use.

Use of Personal Information/Data:

We may process your personal information for the purposes described in this Privacy Policy, with your consent both express and implied when you freely and voluntarily use our portals and services, for compliance with a legal obligation to which Hello PH! is subject, for the performance of a contract to which you are party, in order to protect your vital interests, or when we have assessed it is necessary for the purposes of the legitimate interests pursued by Hello PH! or a third party to whom it may be necessary to disclose information. We may share your information to Travel and Tourism Suppliers such as travel accommodations, ground and sea transportation, air transport providers, local attractions, day activities whose services you purchased or to fulfill your travel reservations. These Suppliers may also contact you when necessary to collect additional information; for important notices in connections to your reservation; to facilitate your meet-up, arrival, stay, and departure; and in response to a review, complaint, or conduct a survey of your experience with them.

We may share your information to Third Party Services who may provide for us services such as data processing, payment processing, bank services, customer services, marketing services, facilitate fulfillment of purchases of products and services, distribution of surveys, and/or fraud detection. Our Third Party Suppliers will only process information as needed to perform their functions. They are not permitted to share or use information for other purposes and follow their respective privacy policies in connection to providing services to us.

The personal information we collect allows us to keep you posted on our latest services, promos, and product announcements, portal and application updates, and upcoming events. If you don’t want to be on our mailing list, you can opt-out anytime by updating your preferences.

We may also use personal information for internal purposes such as auditing, data analysis, and research to improve Hello PH!’s products, services, and customer communications. SCOPE OF OUR SERVICES

Through the Site, Hello PH! provides an online Store where you can browse different types of Travel & Tourism Services and Products, such as but not limited to, Travel Accommodations (“Accommodations”), Ground Transportation (transfers and rentals), Sea Transportation (ferries), Air Transport (flights), (collectively referred to as “Transportation”), Attractions (theme parks and museums), Activities (land and sea), Dining, (collectively referred to as “Activities”), Travel Insurance, and travel & tourism related products and specialty items of Philippine tourist destinations (collectively referred to as “Products”). By making a reservation or purchase on the Site or through agents of the Travel Center, you enter into a direct, legally binding contractual relationship with the Company’s Partners (“Vendors”) in Accommodations, Transportation, and Activities (collectively referred to as “Travel Services”), and/or Products. In your transaction, the Vendors provide reservations for the respective Travel Services or Products you reserved and meet their obligations to Users of the Site or of the Travel Center as their own responsibility. The Company acts solely as an agent or third party between you and the Vendors in facilitating the sending of details and payment of your reservation/s and purchases to the respective Vendors, then sending you a confirmation from the Site or by email for and on behalf of the Vendors. 

TRAVEL SERVICES – ACCOMMODATIONS, TRANSPORTATION, and ACTIVITIES

The Site allows you to search for Travel Services and their prices available by location, store categories, or by search parameters set by the User. The prices displayed are inclusive of Philippine Value Added Tax (VAT), respective service charges of Accommodations, and other relevant fees or local taxes by regulation or by law that have to be collected by the Vendors from their guests or passengers. Prices and details of the Travel Services may change upon the sole discretion of the Company and/or the service providers with or without notice to the User and it is the User’s direct and sole responsibility to determine the most recent and actually applicable prices and details of any Travel Services to be availed and/or purchased. 

“NO” TRAVEL DATES

During the Covid-19 Pandemic and Possible Future Events. Due to the Covid-19 pandemic and future probable events (“Events”) leading towards the “new normal,” travel and tourism operations have become an evolving activity. This is due in part or in whole of many shifting factors that surround the health and safety knowledge, policies in addressing Covid-19, and possible future Events.  Vendors are aware of the predicament for their Guests, such that listings on the Site for Travel Services do not ask for travel dates (“No Travel Dates”) nor do the Vendors require the date of travel or date of use of their offered services when making a reservation or payment. The User on the Site or at the Travel Center is allowed to reserve and advance deposit or pay in full for Travel Services, without the requirement to inform the Vendors of the actual date/s of use for the services they reserved on the Site or from the Travel Center. Certain terms and periods may apply to when the User can avail of the services offered by the Vendor (see below “Validity”). Provided, all parties agree that their correlative rights and obligations shall be subject to and will be amended accordingly to be compliant with the laws, rules, policies, and regulations that would be promulgated by all competent authority at the time of the relevant Event/s.

Many of the products and services available on the Site are vouchers – Users may purchase products and/or services with the intention of future use, with or without a specific travel date. Vendors are aware of the nature of a voucher, such that listings for vouchers for Travel Services on the Site do not ask for travel dates. The User on the Site or at the Travel Center is allowed to reserve and advance deposit or pay in full for Travel Services, without the requirement to inform the Vendors of the actual date/s of use for the services they reserved on the Site or from the Travel Center. Certain terms and periods may apply to vouchers when the User can avail for the products or services offered by the Vendor (see below “Validity”).

ADVANCE DEPOSIT OR PAY IN FULL

Given that No Travel Dates are required when making a reservation or payment on the Site or at the Travel Center for Travel Services, Vendors are extending another flexibility in reservations by accepting Advance Deposits for their services that will “lock-in” on its existing price (“Tuloy Pa Rin Tayo! Rate,” “TPRT Rate”) as listed on the Site on the date of payment of the Advance Deposit (or Full Payment). The User can avail of the Travel Service/s reserved at the TPRT rate during a validity period or travel period specified by the Vendor. The Users will be sent a confirmation (“Voucher”) from the Company on behalf and for the Vendors specifying the Travel Service/s and Unit amounts reserved at the TPRT rate, amount of Advance Deposit paid, and remaining balance for Travel Service/s reserved. Users are required to pay the remaining balance for Travel Services reserved at the TPRT rate upon booking their actual travel dates on the Site or with the Travel Center. 

When you want to redeem your Voucher and book your Travel Dates using the TPRT rate, you will contact the Travel Center through the Site or using the contact information that was included in the Voucher sent via email when your payment was received by the Company for the Voucher of the Travel Service you reserved.

ADVANCE DEPOSITS – Advance Deposits shall be a minimum of 25% of the TPRT rate as listed on the Site. In some cases, Travel Services may have advance deposit requirements that differ from 25% and shall be stated in their respective Site listing.

NON-REFUNDABLE – The minimum 25% Advance Deposits are non-refundable. If the User fails to use their Voucher within the prescribed validity/travel period, the Voucher is considered as forfeited. The User has the option to transfer their Voucher before the end of its validity period, but must comply with the terms and conditions for transfer (see below). The User, in so far as it is not contrary to public policy, hereby freely and voluntarily waives [in consideration of the flexible no date reservation] of any and all rules and regulations that declare that vouchers should not have any expiration period. 

VOUCHER – The Voucher is not a legal tender or an evidence of a financial claim against the Vendor. The Voucher is a representation of the Advance (or Full) payment made and the unit amounts of Travel Services reserved at the TPRT rate by the User; its main function is to facilitate the identity of the User, documentation for the Company and Vendor, and as the summary, additional information, and reminders for the User of the subsequent steps and usage of the Service.

Vouchers cannot be claimed directly with the respective Vendors and can only be redeemed at the Site and/or Travel Center.

SUBJECT TO AVAILABILITY

Users are informed that Travel Services reserved at the TPRT rate with advance deposits only guarantees the locked-in TPRT rate for the given travel period and it does not guarantee or obligate the Vendor/s to fulfill the Travel Services on the User’s preferred travel dates. When you book your travel dates with the Company, it is subject to availability of but not limited to rooms, flights, vehicle and driver, ferry, boat, attraction, and activity. The User hereby agrees that in cases of non-availability for whatever cause adjustments shall accordingly be made without any adverse legal effects on any of the parties.

Upon confirmation by the Vendor/s of the availability of Travel Services for your preferred travel dates, you will be contacted by the Travel Center and can proceed to pay the remaining balance, if applicable, for your reservation. At this juncture, Users can request additional services (“Add-Ons,” see below) or requests for their reservation from the Travel Center and will be included in the invoice that is sent by email.

VALIDITY PERIOD or TRAVEL PERIOD

The Validity Period (“Travel Period”) are the dates of your travel on when you can apply your Voucher. The Travel Period begins on the date you purchase your Voucher and ends on midnight of the Travel Period as stated on the Site listing on the date of purchase or the “Valid Until” date as stated on your Voucher. The Company and the Vendors reserve the right to change the travel period in which the Voucher can be redeemed from the Travel Center and will be stated in their Site listing and affects only Vouchers purchased after the change. The User understands and agrees that the validity period may be shortened or extended in accordance with the promulgated rules and policies by the duly constituted authorities both of the national and/or local government. 

SITE LISTING AND VOUCHER DETAILS

Users are informed that the Company and the Vendors reserve the right to change Site listing details such as but not limited to the travel period, pricing, and inclusions for reasons such as but not limited to promotional purposes, seasonal price changes, and other market factors. Unless otherwise notified by the Company, changes in the Site listing do not apply to Vouchers purchased before the change. In the event of changes being applicable to purchased Vouchers before the change, the Company will issue a new Voucher to the User. Upon issuance of a new Voucher, the associated or replaced Voucher is considered void. Users may then apply the changes using the newly issued Voucher when redeeming the services listed on their Voucher.

The User understands and agrees that Voucher details such as travel period, pricing, and inclusions are subject to change in accordance with the promulgated rules and policies by the duly constituted authorities both of the national and/or local government. 

TRANSFERABLE

Unless stated otherwise on the Store listing, Vouchers issued for Travel Services on the Site are transferable up to 2 times. Vouchers can only be transferred if: (1) it has not yet been redeemed (see below); and (2) the transfer is handled by the Travel Center of the Company. The Company will verify the original purchaser, document the transfer, void the old Voucher, and issue a new Voucher for the transferee with a new Voucher Number. Vendors are unable and do not have the ability to process transfers of Vouchers for their Travel Services. Please contact the Travel Center if you wish to transfer your Voucher to a different person.

A transfer service fee will be charged for the following types of Travel Service Vouchers: Php 300.00/transferee for room night/s; Php 200.00/Ground Rental or Transfer; Php 200.00/one-way flight; Php 50.00/entrance ticket to attractions; Php 100.00/person/Day Activity. These fees are subject to change without prior notice, and at the sole discretion of the Company and/or Vendor/s and/or Service Provider/s.

After the transfer, all benefits, obligations, and Terms and Conditions of Use will be transferred to the transferee. It is the responsibility of the User to inform and make the transferee aware, understand, and agree to the obligations, Terms and Conditions of Use, and Privacy Policy of the Service. Once in the system of the Company, the transferee agrees to follow all the Terms & Conditions of Use and is now considered a “User.”

MANDATORY TRANSFER vs. ASSIGNMENT – A “Mandatory Transfer” is when a Voucher is redeemed and the User is not part of the travel party (member of the group under the reservation); in this instance, the User must contact the Travel Center and transfer their Voucher and it is subject to Transfer fees. An “Assignment” is when the User redeems their Voucher/s, is part of the travel party (member of the group under the reservation), and assigns a portion of the Voucher to be used by other members that are part of the reservation. NO TRANSFER FEES are charged for assigning Travel Services to other members in the reservation when the User is part of the travel party of the reservation.

REDEEMING VOUCHERS

When Users want to book their preferred travel dates, Vouchers can be redeemed from the Site and/or the Travel Center of the Company. Users may include Add-On services for their preferred travel. In order to successfully fulfill the Travel Services of the User, the Travel Center may request additional personal information from the User, such as but not limited to legal name, birthday, gender (for Flights and Ferries), location, flight information (for Ground Transportation), and the personal information of other members of the travel party if the User’s reservation is for two (2) or more persons (see Privacy Policy).

Important note: Only the User can redeem the Voucher at the Site or at the Travel Center or it may be subject to the Mandatory Transfer condition. Users may be requested to provide additional personal information or documents for identification purposes before proceeding with the redemption process. 

ADD-ON SERVICES

The User can Add-On Services when redeeming their Vouchers. Existing rates of the Vendor of time of travel will be applied to Add-On services ordered by you when redeeming your Voucher at the Site or Travel Center. Billing of Add-On Services will be included in the Invoice with the remaining balance, if applicable, of the Voucher. Some Add-On Services of the Vendor may be ordered with the Vendor during the use of the Travel Service and can be paid directly to the Vendor. 

Please note that Vendors reserve the right to refuse Add-On Services if it significantly alters the reservation or does not comply with current regulatory policies or law; an example of this are having more additional people in a room or in a rental vehicle that exceed its allowable occupancy.  In the instance that requested Add-On Services alter significantly the reservation and do not comply with current regulatory policies or law, the Vendor reserves the right to refuse to fulfill the reservation and “Cancellation/No Show” terms and conditions of the Vendor may apply (see Vendor Terms & Conditions below). We urge you to inform the Travel Center of all the details of your travel party, requirements, and special requests when redeeming your Voucher. And this refusal is valid and binding on the User and will not cause any adverse practical or legal effect on the Company and/or Vendor/s.

You agree and hold the Company and the Vendor free and harmless and not be liable to any person or entity for direct, indirect, incidental, actual, compensatory, exemplary, nominal or any damages due to the rightful refusal of the Vendor to fulfill Travel Services if the travel party of the User and/or their details are significantly different from the reservation or do not comply with existing policies, regulatory or by law, on the day of your arrival at the location of the Travel Services being performed. 

TRAVEL CONFIRMATION, ITINERARY, and TICKETS

A Voucher is successfully redeemed when the respective Vendor has communicated availability for your travel dates, you have fully paid for the reservation, the Vendor has confirmed the reservation, and a “Travel Confirmation” or Flight Itinerary has been issued by the Company in behalf of and for the Vendor. When you redeem your Voucher and complete your reservation, you enter into an agreement with the Vendor/s regarding the use of the Travel Services reserved and paid for (“Reservation Agreement”). 

Your Travel Confirmation and/or your Flight Itinerary will be emailed to you via email from the Travel Center. Your Travel Confirmation will be needed for the purposes of check-in at Travel Accommodations, Pick-Up for Ground Transportation, Registration for Activities, and/or to redeem your entrance tickets for Attractions.

Travel Confirmation – A Travel Confirmation is not a legal tender or an evidence of financial claim on the Vendor or the Company. The Travel Confirmation is only a representation of your Reservation Agreement with the Vendor/s – the Travel Services, its unit amounts, add-on services when applicable, your payment, your specified travel dates, your personal information required for the fulfillment, and the usage of your Travel Services. Your Travel Confirmation only facilitates the ease in identifying and finding your reservation in the systems of the Vendor and of the Company. Your Reservation is only valid when confirmed by the systems of both the Vendor and the Company. The Company and the Vendor are required to ask for proper proof of identity of the User and members of the travel party at the start of the Travel Services being rendered. (For lost Travel Confirmations, please contact the Travel Center.)

VENDOR TERMS & CONDITIONS

By entering a Reservation Agreement, You make a legal declaration that You have the legal and juridical capacity to do so in accordance with the jurisdiction of your residence and the residence of the Company and/or Vendor/s and that you freely and voluntarily agree to bound by these Vendor Terms and Conditions, including any revision, amendments, repeal or deactivation of all or any part hereof in relation to your reservation, including but not limited to, Cancellation, No-Show Policies, Blackout Dates. The relevant Vendor’s Cancellation, No-Show Policies, Blackout Dates Policy, and other relevant policies in regards to your reservation are collectively included in the Site listing, the Voucher you will receive, and/or from communication made by our Travel Center via phonecall, email, text, or other reasonable forms of communication made between you and our Travel Center. You may contact our Travel Center using the contact information included in your Voucher for further clarification of your relevant Vendor’s Terms & Conditions. 

BLACKOUT DATES – Blackout dates are dates in the calendar year that Vendors may choose, not to honor promotional, discounted, or “deal” rates, such as the TPRT rate. These are dates that have unusually high volume or demand for Travel Services due to special events (like fiestas or sporting events) in the location of the Vendor, special holidays (like Holy Week, Christmas, New Year’s Eve), or Holidays of visiting foreign tourists (like Obon week of Japan, Chuseok holiday of Korea, etc.) Users of Vouchers with the TPRT rate may reserve on these blackout rates, but will have to comply and pay for any additional charges required from the Vendor. (Please note that “Blackout Dates” have local or establishment specific other “names” or terminology to refer to the definition of blackout dates above, such as but not limited to, ”Super Peak Dates,” “Peak Dates,” etc.)

PERSONAL INFORMATION, TRAVEL DATES, & DETAILS OF THE RESERVATION

It is the Users responsibility to ensure the practical and legal validity, accuracy, correctness, and completeness of their personal information and the other members of their travel party, their travel dates or dates of usage of the Travel Services, and other pertinent details included in their reservation when booking their Travel Services and upon receiving their Travel Confirmation or Flight Itinerary.

The User is aware and agrees that Travel Services may be refused to be fulfilled by the Vendor, delayed, or additional charges must be paid before it is fulfilled for inaccurate, incorrect, and/or incomplete information on their Travel Confirmation or Flight Itinerary for situations such as but not limited to the User not being present or not a member of the travel party, name/s on Flight Itinerary that are different from the government I.D. presented at the check-in counter, excessive baggage beyond the prepaid check-in baggage for Flights, excessive number of people or baggage beyond the acceptable capacity of the booked vehicle, wrong date and/or time booked for the travel service, inaccurate pick-up location, etc.

The User and the other members in the travel party under the Reservation Agreement agree and hold the Company and the Vendor harmless and not be liable to any person or entity for direct, indirect, incidental, actual, compensatory, exemplary, nominal or any damages due to the refusal to fulfill Travel Services or a delay in the fulfillment due to inaccurate, incorrect, and/or incomplete information on their Travel Confirmation or Flight Itinerary. Furthermore the User and their travel party agree that any additional charges, expense, or costs due to the non-fulfillment or delay of their Travel Services are solely their responsibility such as but not limited to additional nights at a different travel accommodation, additional travel and meal expenses, new reservation for flights or ferry tickets, etc.

CANCELLATIONS

For Travel Services, by entering into a Reservation Agreement, you accept and agree to the applicable Cancellation/No-Show Policies of the relevant Vendor. The Cancellation and No-Show policies of the Vendor are available in the Voucher you received, through inquiry to our Travel Center, and reminded in the event of processing a Cancellation. You agree to pay any cancellation charges specified in these policies. The Company may charge a cancellation processing fee, which will be included and mentioned during the cancellation processing of your reservation. Please note that some products and Travel Services may not be eligible for cancellation and refund due to but not limited to special offer rates, promotional rates which are specified in the listing of said types of products and Travel Services.

The Company and the Vendor reserve the right to cancel specific reservations in the event of force majeure, or from acts beyond its reasonable control including, but not limited to, cases of natural calamities, other acts of God, terrorist acts, shortage of supply, breakdowns or malfunctions, interruptions or malfunctions of computer facilities, or loss of data due to power failures or mechanical difficulties with information storage or retrieval systems, labor difficulties, rebellion, or for whatever reasons it deems appropriate, without the need to justify the cancellation. In such cases, you will be notified through the most convenient and practical means and within 24-hours upon cancellation and advised of the specified procedure to follow. The Company and the Vendor also reserve the right to cancel specific activities or travel due to driver recommendation, captain or boat crew recommendations, tour guide or Dive Master recommendations when they invoke a safety reason for the cancellation such as but not limited to poor visibility, heavy rains, road hazards, travel at night after 10:00PM, boat travel after the sun has set, weather and/or wave conditions, inability of the guests to perform the activity, a member of the group has put themselves or the rest of the party in danger, unruly and intoxicated guests, if a guest does not follow the safety protocols of the activity, a guest commits an illegal action or has in possession illegal and dangerous items, or other reasons that puts the comfort or safety at risk of the Company, the Vendor, their employees, you, other guests, and the people in the surrounding area.

To cancel your reservation, please contact the Travel Center using the numbers and email that are provided in your Travel Confirmation email and follow the instructions given to you by agents of the Travel Center.  

In some instances, you may be due for refunds after the cancellation has been completed and all obligations to the Vendor and the Company have been satisfied. Please note that refunds may not be available immediately depending on your initial mode of payment. You may contact the Travel Center on the estimated duration for receiving your refund. Any fees related to the remittance of the refund to the User will be at the cost of the User and deducted from the total amount of the refund remitted. 

When you initiate a cancellation, cancellation shall take effect once the Company issues a cancellation notice for and in behalf of the Vendor. The cancellation notice may be issued to the email provided by you when you made your reservation. The Company will make all reasonable efforts to transmit the cancellation notice, but does not make any warranties covering failures to receive the cancellation confirmation email, in case of non-receipt of email. 

If you fail to appear on the scheduled day of departure for your Flights, the check-in and inclusive dates for your Travel Accommodation, and/or the Pick-Up point/Meeting Place for your Activities without any prior notice, and as a result fail to use the relevant Vendor, the Company and the Vendor shall deem such failure as Cancellation without notice and/or No-show, according to the relevant Cancellation and/or No-show policies. You agree that you will be forfeiting a portion of or the full amount of your payment according to the relevant Terms & Conditions. The Company and the Vendor may also take necessary measures (including legal measures), such as the suspension of the use of all the services relating to the Site and the Service or cancellation of your account. 

The Company and the Vendor reserve the right to cancel specific reservations for whatever reason it deems appropriate. In such cases, you will be notified and advised of the specified procedure to follow.

In exception for Flights, cancellations must be coursed through the Company. Cancellations made through the Vendors are not allowed for your privacy and protection and will not be entertained by the Vendor, unless with confirmation from the Company (or in the case for Travel Accommodations, you are already a checked-in guest, your identity is known by the establishment, and you are cancelling the remainder of your stay). 

CREDIT and/or DEBIT CARD USE

The Company uses multiple third-party systems to process credit and/or debit card transactions and does not collect or store any credit and/or debit card information provided. 

If you use a credit and/or debit card for your payment, you represent that the card is your own and you commit to make the necessary payments as required by your bank or credit and/or debit card provider. You take full responsibility for the transactions made using your credit and/or credit card.

The Company makes all reasonable efforts to prevent and investigate credit and/or debit card fraud and unauthorized or illegal use of Travel Confirmations. These measures include requiring Vendors to check the User’s identification upon check-in or at the start of an Activity to verify their names against the credit and/or debit card used for payment. However, the Company makes no warranties relating to the effectiveness of this procedure to prevent fraud and shall not be held liable for any cases of credit and/or debit card misuse or fraud.

You are responsible for immediately reporting suspected credit and/or debit card fraud to your bank or credit and/or debit card provider and the Company. In such an event, you shall provide formal documentation or proof of fraud.

In the event of credit and/or debit card fraud or disputes, if fraud is proven and the required documentation is provided, the Company will refund the full amount of the Reservation Agreement, as stated in the travel confirmation and verified by the Company’s System, provided the Reservation Agreement is unconsummated and the Travel Service has not yet been provided or the Product has not been delivered. However, if the Travel Service has already been provided by the Vendor or the Product delivered, the Company will not make any refunds.

Should you fail to receive a Voucher or a Travel Confirmation email after attempting to reserve with a credit and/or debit card, the reservation shall be treated as “not been confirmed” by the Company. It is the User’s responsibility to verify the successful and timely remittance of payment by their bank or credit/debit card provider. The User holds the Company and the Vendor free and harmless of any loss or damage, directly or indirectly, that results in the situations such as, but not limited to, non-booking of requested Travel Service, resulting unavailability of preferred Vendor and/or their Service, refusal of Vendor to perform services due to the lack of a Travel Confirmation and/or lack of registry in their reservation system from delays or unsuccessful  payment transaction. In the event that your card has been charged, the Company is willing to help you process a refund or find an alternative Vendor and/or date for your reservation. However, the Company shall not be responsible for any price difference incurred from the change of the original requested Travel Service/s. 

In the event of unsuccessful payment transactions, your bank or credit/debit card provider will be responsible in informing you of the failed transaction. The Company may contact you through the Travel Center, to inquire whether you wish to continue your reservation and the instructions on how to proceed.  

Please note that the Company, the Vendor, its employees or representatives will never ask for your CSV number, pin number, or One-Time-Password. In such a case, it is the User’s responsibility to treat the event as suspect, immediately contact their credit/debit card provider, and the Company. The User will hold the Company free and harmless from any loss or damage due to the User’s sharing of sensitive information of their credit/debit card. 

Offline Payment

For payments not processed on the Site, such as but not limited to deposits to the Company’s bank accounts, email invoicing, text invoicing, PayPal payment request, PayMaya payment request, MLhuiller payment request, you will receive an email from the Site, the Travel Center, and/or our third party payment supplier with the proper instructions of how to send your payment. 

(Please note that all account names for bank accounts and third party payment accounts are registered under the legal name of the Company, “Hello PH Tourism Inc.” That you receive an invitation to make a payment to an account under an individual’s name or other than the Company’s name must be taken as suspect and reported immediately to the Travel Center. It is no longer the responsibility of the Company, if the User remits a payment to an account other than to Hello PH Tourism Inc. and/or to a bank account or payment provider not listed on our Site.)

THIRD PARTY PAYMENT FACILITY FEES

The Company reserves the right to charge additional Third Party Payment Facility Fees on top of the total billing when the User requests third party payment channels that are subject to additional expenses to facilitate payment of the User. 

SCOPE OF OUR SERVICES

Users are aware and agree that availability and price of the Travel Services being paid may change without prior notice even during the payment process. In the event that the Vendor is no longer available or the price has increased after the payment is confirmed, the reservation can be cancelled or amended. The Company is willing to help you process a refund, find an alternative Travel Service provider, and/or collect the price difference to continue the reservation. However, the Company shall not be responsible for any price difference incurred.

When rendering our Service, the information that we disclose about Travel Services and Products are based on the information provided to us by our Partners in Accommodations, Transportation, Activities, and Products (including but not necessarily limited to our Partners’, their representatives, distributors, channel managers, partners, etc.). As such, the Partners of Travel Services and Products or their representatives are responsible in submitting in a timely manner to the Company updates on all rates, Vendor Terms & Conditions, confirm the validity and accuracy of descriptions, pictures, booking conditions, payment conditions, vendor policies, and other information that is displayed on the Site. Although we will use commercially reasonable skill and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate, complete, correct or up to date, nor can we be held responsible for any errors (including manifest and typographical errors), interruptions of updating information (whether due to any temporary and/or partial, breakdown, repair, upgrade, or maintenance of the Site or otherwise), inaccurate, misleading, or untrue information or non-delivery of information. Each Vendor is remains responsible at all times for the accuracy, completeness and correctness of their Travel Service or Product information displayed on the Site. The company cannot be held responsible during the time period between inaccurate information when found or submitted by the Vendors and the actual update of the correct information on the Site. Also, changes in market conditions and circumstances may occur on short notice, which may make information displayed on the Site outdated or inaccurate. In case of problems, our Travel Center will use its commercially reasonable efforts to assist you and serve as a point of contact with the relevant Vendors of Travel Services and/or Products. 

The Site does not constitute and should not be regarded as a recommendation or endorsement of (the quality, service level or rating of) any Travel Service or Product listed on the Site. We hereby expressly disclaim any representation, warranty or undertaking in relation to the quality, status or adequacy of any Travel Service or Product listed on the Site. In the category of Travel Accommodations, a “rating” is provided, but is based solely on a scale where the Price of the Partners current Published/Walk-in rate falls “categorically” in. 

To the extent permitted by applicable law, we reserve the right to, and our discretion, refuse or cancel reservation requests, Vouchers, or reservation agreements in exceptional cases and will notify you of the refusal or cancellation by email to the address you provided when you made your booking. Typical reasons for rejecting or cancelling a reservation requests, Vouchers, or reservation agreements include, but are not limited to, actual or suspected reselling of Travel Services and Products booked through the Site on an individual or mass basis without our prior written approval (“Reselling”), breach of the Terms of Use, force majeure events, trade or economic sanctions, embargoes, legal restrictions, (suspicions of) fraud or theft, suspected criminal activity, suspicious bookings, submission by you of misleading or erroneous information, Payment Instrument problems, inappropriate behavior, threats, insults, violence, refusal to supply information, practical obstacles, communication problems, errors, history, blacklisting by governments or international organizations (USA, EU, UN, Singapore), etc. If your reservation, Voucher, or Reservation Agreement  is rejected or cancelled by the Company and a payment has already been made, you will receive a refund of the total booking value, (except in the case of unauthorized Reselling or in any other appropriate case such as unauthorized use of the Site or there is an inappropriate manner in the use of the Site, and such use is harmful to us for which the refund of the total reservation value or any part thereof is not justifiable). Refunds will not be issued in the event of unauthorized Reselling due to many negative factors including the disadvantage such practice imposes on our Partners of Travel Services and Products who provide the Company with inventory on a contracted and trusted basis and the loss and negative brand impact caused to Hello PH! due to unauthorized Resellers attempting to undercut the Company’s business. We also reserve the right to bar (“blacklist”) Users from the Site, on a permanent or temporary basis, at our discretion. Any such blacklisted User must not attempt to use the Site under any other name or through any other User. 

In rare cases, we may also have to cancel or reject a booking or make adjustments due to errors, independent of the origin of such errors, when the error is substantially or materially different from the actual information, for example a price on the Site or miscalculation of total billing by an agent of the Travel Center, which a reasonable person would notice to be an error.  If your booking is affected by such an error, we will notify you by email at the address you provided when you made the booking and will adjust the booking  appropriately, and will, if relevant, refund some or all of the amount charged.

Please note that group bookings can also be rejected or cancelled by the Company or the Travel Service Vendor, if they have specific procedures for group bookings. Group bookings are welcomed by the Company and you may Contact Us for consultation of how to book your group booking.

USE OF THE SITE

The Company grants you a limited, restricted, personal, non-transferable, non-sublicensable, revocable license to access and use the Site only as expressly permitted in the Terms and Conditions of Use. Except for this limited license, we do not grant you any other rights or license with respect to the Site; any rights or licenses not expressly granted herein are reserved. The content and information on the Site is proprietary to the Company or its Vendors. You may only use the Site to make bona fide and legitimate inquiries or reservations and you hereby undertake not to make any speculative, false or fraudulent requests or any reservations in anticipation of demand. You undertake that the payment details you provide us with in making a booking are fully correct. You also undertake to provide correct and accurate e-mail, address of residence, and/or other contact details to the Company and acknowledge that we may use these details to contact you in the event that this should prove necessary. Accordingly, as a condition of using the Site, you agree not to use the Site or its contents or information for any commercial or non-personal purpose (direct or indirect) or for any purpose that is illegal, unlawful or prohibited by the Terms and Conditions of Use. Except with our prior written authorization, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, products, or services obtained from the Site. In addition, you agree not to:

use the Site or its contents for any non-authorized commercial purpose such as reselling of bookings;

make any speculative, false, or fraudulent booking;

make use of any robot, spider, scraper, or other automated means or manual means to monitor, copy, download, reproduce, display content and/or information, travel services, products available on the Site for any commercial, competitive, or malicious activity or purpose;

on our discretion, using or subjecting the Site to actions that imposes, or may impose an unreasonable or disproportionately large load on our system, server, or infrastructure;

other actions that depart from the personal use and intended use of the Services available on the Site for commercial, illegal, and/or malicious use such as but not limited to mining,  harvesting, hacking, black hat techniques, spamdexing, deep linking, framing or mirroring, “hi-jacking” email systems or server to deliver or provide links to postings which are not of the Company, are unlawful (to any and all applicable laws or regulations), contain material that is objectionable, advocate illegal activity, pornographic, defamatory, slanderous, false or libelous, violates intellectual property, etc.;

to use a false identity and/or impersonate another person or entity, misrepresent your affiliation to a User, Vendor, or other person or entity with the purpose to mislead, deceive, or defraud another;

use the Site in any manner which could damage, disable, overburden, or impair or otherwise interfere with the use of the Site or other Users’ computer equipment, or cause damage, disruption or limit the functioning of any software, hardware, or telecommunications equipment;

attempt to gain unauthorized access to the Site, any related website, other accounts, computer system, or networks connected to the Site, through hacking, password mining, or any other means;

do anything else which could cause damage to the Site, its Users, Hello PH!, its Vendors, each of their employees and reputations, or would otherwise have a negative impact; or

aid or abet any of the above.

Unless otherwise expressly permitted, websites may not hyperlink to any page beyond the homepage of the Site or frame the Site or any web page or material herein, nor may any entity hyperlink any aspect of the Site in an email for commercial purposes without the express written permission of Hello PH!

The Company may use proprietary or third party technology (e.g. Google reCAPTCHA) on pages of its Site to keep the Site safe from malicious attackers or anyone who abuses the Site.

If any damage is incurred by the Company or any third party as a result of your actions which are categorized as any of the acts listed above, you shall assume full legal liability and shall hold the Company or such party harmless for such damage.

You represent that you are of legal age and possess the legal and juridical capacity to enter into legally binding obligations by virtue of your personal circumstances and/or in accordance with an authroity duly given to you in a legall binding document If you are a minor, you represent that in making any reservations you only supplied the details and information but all acdtions requiring legal and juridical capacity were made directly by  your legal guardian. If you misrepresent your age and any applicable consent, any of your subsequent actions may be rescinded and all payments forfeited to answer for the damages caused by your misrepresentation, at the sole discretion of the Company and/or Vendor/s.

If and when applicable, you will satisfy all your obligations, tax, withholding or otherwise as required by your country of residence.

If you breach any of the above User responsibilities as set forth in the preceding items, or the Company otherwise determines any of your actions to be incompatible with the operation of the Service, the Company reserves the right to cause you to cease such act, and cancel the Reservation Agreement between you and the relevant Vendor, and may take necessary measures (including legal measures) against you, such as suspension of the use of all the services relating to the Site and the Service, cancellation of membership, or demand for payment of damages.

REVIEWS

A “Review” refers to any form of content, such as but not limited to Travel Service, Vendor, its employees, service provided, and Product reviews and comments, submitted to the Company on the Site’s review facility or its social media channels.

By submitting a Review to this Site or our Social Media channels, you understand and agree to all Terms and Conditions as stated below.

Posting reviews about a travel service is exclusive only for members who have booked the travel service through www.rebuild.phtourism.com/tuloy-pa-rin-tayo. You can only post a review about the travel service once per booking.

You grant the Company full, perpetual, irrevocable, free, and transferable rights to all User submitted Reviews including your name as stated in your submission. Any Review submitted to the Company is considered non-confidential and non-proprietary. The Company reserves the right to use the Review as it deems appropriate including but not limited to reproducing, editing, modifying, publishing, rejecting, or deleting the Review at its sole discretion without prior notice to User. You also grant the Company the right to distribute or share the Review with Travel Service and Product partners.

The Company is not obligated to publish your Review and reserves the right to decide whether or not to publish your Review at its sole and absolute discretion. We are also not obligated to allow you to modify or delete the Review after it has been submitted to the Company. The Company shall not immediately release Reviews upon submission. Reviews for Travel Services or Products shall only be displayed on the Site after approval by the Company Management 

The Company is not liable and assumes no responsibility for any Review you submit. By submitting a Review to this site, you agree that you are solely responsible for the Review you submit. You must abide by the Company’s Review Guidelines, and you must not post a Review that violates the Company’s Terms and Conditions. You shall be held solely liable for any damages and other harmful consequences that result from violating these guidelines and restrictions.

All reviews submitted must abide by the guidelines such as but not limited to the following:

  • All Reviews must be related to your experience with the Travel Service or Product. No irrelevant posts such as but not limited to commentaries unhelpful in the decision to use the Travel Service or Product, personal religious and political views, personal insults, name calling, smear campaigns, or reviews with intent to damage the reputation of the Vendor, the Company, an individual or entity, derogatory comments about other reviews, trolling, profanity, obscenity, hate speech, discriminatory, racial slurs, vulgarity, libelous statements, etc.
  • All Reviews must be truthful and objective. You must have personally experienced the Travel Service or Product, no using of secondhand information or quoting of other sources.
  • All Reviews should follow email etiquette and does not use excessive slang, all caps, symbols, repetitive html tags,
  • No Reviews are permitted from individuals affiliated with a Vendor about their Travel Services or its competitors.
  • No Reviews should be used for promoting personal businesses, websites, services, and product for the purpose of selling or marketing. No posting of email addresses, phone numbers, links for the purpose of promotion.
  • No content that violates any law including but not limited to the rights to privacy and publicity, the Data Privacy Act of 2012, the Cybercrime Prevention Act of 2012, and copyright and trademark laws is allowed.
  • No Reviews shall include the posting of personal information of yourself, others, and entities in breach of the Data Privacy Act of 2012.

 

The Company reserves the right to pursue at law any person or entity that violates your, our Vendor’s, or the Company’s rights in the Review by a breach of these Terms and Conditions.

It is understood that notwithstanding the acceptance and publication of your Review, it is not the Company’s responsibility to guarantee the truthfulness and veracity of the contents thereof. Upon publication of your Review, you agree to take full responsibility of whatever legal consequences that may arise, including but not limited to any claim for damages and intellectual property rights or any other applicable law or regulation. The publication of your Review by the Company does not create any property right in your favor which may be enforced against the Company. The Company shall have the sole discretion and prerogative to withdraw your published Review for whatever cause at any time it may deem necessary and/or appropriate without prior notice.

COPYRIGHT  

The content and information are owned and managed by Hello PH! and its Vendors. You agree not to use any content provided in the Site, the Travel Services, and/or Products without the Company’s prior approval, beyond the scope of your private use as set forth in the Copyright Act. 

If a dispute may arise from as a result of a User’s breach of any provision of the Copyright Act, the User shall be responsible for resolving the dispute at the User’s own expense, and shall indemnify and hold harmless the Company, its officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate or distribution partners, licensees, agents, or others involved in creating, sponsoring, promoting, or otherwise making available the Site and its contents against any liability or damages associated with such a dispute.

If you notice the improper use and/or your copyright protected content in this Site, please contact the Company immediately so we may take the appropriate actions to correct. The Company and its Vendors makes commercially reasonable effort in sorting, vetting, acquiring, and loading content on the Site.

PRIVACY PROTECTION

Please refer to the separate Privacy Policy established and adopted by our Site which is equally applicable and has been duly communicated to Vendor/s.

INDEMNIFICATION AND LIMITATION OF LIABILITY

The Company has no obligation to investigate the business conditions or similar conditions of any Vendor. The Company shall not be liable for any damages due to any loss, delay or erroneous transmission of information as a result of a natural disaster, congestion of lines, equipment failure or equipment maintenance; the termination of the Vendor’s participation, any alteration or divulgence of information by a third party, or similar cause. The Company shall not be liable for the delivery of the Reservation Agreement and Travel Services or Product by the Vendor. If any problems, concerns, or complaints arise between you and the Vendor regarding the Reservation Agreement or the Product, you agree to settle the dispute with the Vendor and indemnify and hold harmless the Company for any losses, damages, and costs incurred during such settlement.

The Company shall not be liable for any untoward incidents, such as theft, fire, flood, transport strikes, natural disasters, or similar events, that occur on the premises or in the general vicinity where the Travel Services being performed, during your stay in the Travel Accommodations or during your travel dates.

You agree and hold the Company and the Vendor free and harmless and not be liable to any person or entity for direct, indirect, incidental, actual, compensatory, exemplary, nominal or any damages due to the rightful refusal of the Vendor to fulfill Travel Services if the travel party of the User and/or their details are significantly different from the reservation or do not comply with existing policies, regulatory or by law, on the day of your arrival at the location of the Travel Services being performed. 

Subject to the limitations set out in these Terms and Conditions and to the extent permitted by law, the Company shall only be liable up to an aggregate amount equal to the aggregate cost of the User’s reservation as set out in the travel confirmation email for direct damages actually suffered, paid or incurred by the User due to an attributable shortcoming of the Company’s obligations relating to the Service (whether for one event or series of connected events).

However, and to the extent permitted by law, neither the Company nor any of its officers, directors, employees, representatives, distributors, affiliate or distribution partners, licensees, agents, or others involved in creating, sponsoring, promoting, or otherwise making available the Site and its contents, shall be liable for any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, any inaccuracy relating to the information, including rates and availability of the Vendor as made available on the Site https://rebuild.phtourism.com and https://tuloyparintayo.phtourism.com the services or facilities offered by the Company and the Vendor, any direct, indirect, consequential, or punitive damages, losses or costs suffered, incurred or paid by the User, pursuant to, arising out of or in connection with the use, inability to use or delay of the Site, or for any personal injury, death, property damage, or other direct, indirect, special, consequential, or punitive damages, losses or costs suffered, incurred or paid by the User, whether due to legal acts, errors, breaches, gross negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or wholly or partly attributable to the Vendor, its employees, directors, officers, agents, representatives or affiliated companies, including any cancellation, overbooking, strike, force majeure or any other event beyond its control.

HEALTH & SAFETY PROTOCOLS

The User and his/her guests undertake and warrant that they shall conduct and maintain proper personal hygiene protocols and social distancing as per prevailing guidelines of the Department of Health, Department of Tourism, regulatory policies or law, or Establishment Policies of their chosen Travel Services. 

Hello PH! does not guarantee nor shall it make any representations to Travel Services or any other persons as to the User’s fitness to travel. Users shall willingly provide truthful travel history, possible contact/exposure with covid-19 positive cases, quarantine history, medical history, and answers to other questions pertaining to their fitness of travel if asked upon booking their travel dates or at start of the fulfillment of Travel Services. Users shall willingly sign waivers upon request of the Travel Services and/or of Hello PH! 

The User and his/her guests shall indemnify and hold Hello PH! free and harmless in the event of damage or loss sustained by the Travel Accommodations due to User’s negligence or deficiencies in following guidelines and protocols or deliberate act causing damages when enjoying Travel Services purchased through the Tuloy Pa Rin Tayo! Store; damage or loss sustained by the User and his/her guests due to negligence and deficiencies of other guests of the Travel Services in following guidelines and protocols; damage or loss sustained due to sudden renewed lockdowns, quarantines, or travel restrictions that result in the inability to continue with the paid services purchased through the Tuloy Pa Rin Tayo! Store; and/or inability to leave the premises and/or return to one’s residence. 

Neither does Hello PH! guarantee the conduct and maintenance of regular and adequate protocols of the Travel Services to ensure the health and safety of its guests and the former are charged with and solely responsible for observing their own health and safety protocols of its Employees, of their guests, and/or fulfillment of Travel Services. Hello PH! is a third party agent in bringing the User and Travel Services together. The personal responsibilities of the User and the Travel Services to follow proper hygiene and safety protocols post-covid-19 are outside the responsibility of Hello PH! 

MODIFICATIONS TO THE TERMS AND CONDITIONS

The Company may make additions and deletions to, or otherwise modify these Terms and Conditions without any prior notice. You agree to check these Terms and Conditions each time you use the Service. If you use the Service after any modification is made to these Terms and Conditions, you shall be considered to have agreed to the modified Terms and Conditions.

FORCE MAJEURE

Hello PH! nor its Vendors will not be held liable for any failure of or delay in the services rendered directly or indirectly occurred by or through or in consequence of causes beyond its reasonable control, including but not limited to acts of God, war, civil unrest, strikes or labor disputes, government orders, or any other force majeure event.

GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the Philippines, to the exclusion of all other jurisdictions. All disputes involving this Agreement and the use of the Site and its Services shall be exclusively resolved in the courts of the Philippines. Any claim or dispute arising out of or relating to this Agreement, which results in a legal proceeding shall be decided exclusively by a court of competent jurisdiction in Cebu City, Philippines.

Your privacy is important to Hello PH! so we’ve developed a privacy policy that covers how we collect, use, disclose, transfer, and store your personal information, when you visit or interact on our Site or other means of connecting to the Site such as, but not limited to contact, inquiry, subscription forms, sending a review; contacting our customer service team via chat, email, or mobile text; or social media channels. OUR COMPANY WIDE COMMITMENT TO YOUR PRIVACY

To make sure your personal information is secure, we communicate and make binding our privacy and security guidelines to Hello PH! employees and strictly enforce privacy safeguards within the company.

COLLECTION AND USE OF PERSONAL INFORMATION/DATA

Personal information is data that can be used to identify or contact a single person, a group of persons whether incorporated or unincorporated, and legal or judicial persons and entities. Note that identifiers are used here either singly or collectively but are generally referencing the data subject/owner, whether solitary or collective. 

You may be asked to provide your personal information anytime you are in contact with Hello PH! We may also combine it with other information to provide and improve our products, services, content, and advertising. You are not required to provide the personal information that we have requested, but, if you chose not to do so, in many cases we will not be able to provide you with our products or services or respond to any queries you may have.

Collection of Personal Information/Data:

When you create an TPRT profile or account, purchase a product or service, register for a bundled service/promo with us, connect to our services, contact us including by social media or participate in an online survey, we may collect a variety of information, including your name – legal and assumed, mailing and/or residence address, phone number, email address/es, contact preferences, device identifiers, IP address, location information, travel information and preference/s both in the past and intended, and other profile information including posts and entries where the contact is via social media.

By signing up for a member account using your social media  or google account, the Site collects information that automatically populates member information to facilitate the use of the Site. 

By visiting our Site, we may collect usage information automatically, such as your IP address, geographic data, country, search preferences, browser and information about your device’s operating system, pages that have been shown to you, the origin (ad, social media post, page, email) that led you to our Site.

When you share your content with family and friends using Hello PH! products and services, send gift certificates and service vouchers, or invite others to participate in Hello PH! services or visit the pages of our Site, Hello PH! may collect the information you provide about those people such as name, mailing address, email address, and phone number. Hello PH! will use such information to fulfill your requests, provide the relevant product or services, or for anti-fraud purposes.

To facilitate and successfully service your requests, purchases, booking of travel dates, and managing reservations for travel accommodations, ground and sea transportation, booking airfare, day activites, meals, other tourism services, purchasing travel products, or as required by law, we may ask for information such as but not limited to a government issued ID, passport information, age, birthday, gender, country of residence, address, email, mobile number, location, accommodation, length of stay, itinerary of your travel, flight information, 

When there are other members in your group who are part of your booking, if you are booking for someone else, or if you are booking a gift for someone else, it is your responsibility to provide the correct information of your guests or beneficiary and that you have made them aware of sharing their personal information; and they understand and agree to how their information is used.

In some cases, other personal or sensitive information like religion and health condition will be asked for the limited reasons of health, safety, and special conditions such as food allergies, religious dietary restrictions, capacity to perform activities (such as hiking, SCUBA, water activities, amusement rides), or as part of the process of cancellation or refund due to a health reason that a third party provider of service may request. 

In regards to the new environment of health and safety policies revolving around Covid-19, we may ask for additional information such as health conditions, travel history, contact history, and test results for Covid-19 that may be requested by our providers of travel and tourism services, local government units (LGU), government agencies, or by law to successfully facilitate your requests, bookings, managing your reservation and travel; and when applicable, to contact you after your travel dates and services have been performed.      

When you contact us via the multiple forms in our Site, email, mobile number, VOIP, social media accounts, we may collect your personal information to perform your request, purchase, manage your booking, for anti-fraud, anti-money laundering, regulatory policy, or required by law. 

Credit Card Information

Hello PH! does not collect credit card information. All payment processing with the use of credit cards and collection of credit card information are performed by Third Party Payment Service Providers such as but not limited to PayPal, Payoneer, and PayMaya.

Upon check out and payment for services and products on our Site, you may choose which Third Party Service Provider of credit card processing you are most comfortable to use. 

Use of Personal Information/Data:

We may process your personal information for the purposes described in this Privacy Policy, with your consent both express and implied when you freely and voluntarily use our portals and services, for compliance with a legal obligation to which Hello PH! is subject, for the performance of a contract to which you are party, in order to protect your vital interests, or when we have assessed it is necessary for the purposes of the legitimate interests pursued by Hello PH! or a third party to whom it may be necessary to disclose information. If you have questions about this legal basis you can contact the Data Protection Officer as contained in our portals and legal documents and submitted to the appropriate government agencies.

We may share your information to Travel and Tourism Suppliers such as travel accommodations, ground and sea transportation, air transport providers, local attractions, day activities whose services you purchased or to fulfill your travel reservations. These Suppliers may also contact you when necessary to collect additional information; for important notices in connections to your reservation; to facilitate your meet-up, arrival, stay, and departure; and in response to a review, complaint, or conduct a survey of your experience with them.

We may share your information to Third Party Services who may provide for us services such as data processing, payment processing, bank services, customer services, marketing services, facilitate fulfillment of purchases of products and services, distribution of surveys, and/or fraud detection. Our Third Party Suppliers will only process information as needed to perform their functions. They are not permitted to share or use information for other purposes and follow their respective privacy policies in connection to providing services to us.

The personal information we collect allows us to keep you posted on our latest services, promos, and product announcements, portal and application updates, and upcoming events. If you don’t want to be on our mailing list, you can opt-out anytime by updating your preferences.

We also use personal information to help us create, develop, operate, deliver, and improve our products, services, content and advertising, and for loss prevention and anti-fraud purposes. We may also use your personal information for account and network security purposes, including in order to protect our services for the benefit of all our users. Where we use your information for anti-fraud purposes it arises from the conduct of an online transaction with us. We limit our uses of data for anti-fraud purposes to those which are strictly necessary and within our assessed legitimate interests to protect our customers and our services. For certain online transactions we may also validate the information provided by you with publicly accessible sources.

We may use your personal information, including date of birth, to verify identity, assist with identification of users, and to determine appropriate services. For example, we may use date of birth to determine the age of TPRT account holders.

From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with Hello PH!, you may not opt out of receiving these communications. This is especially important during times of pandemic and calamities where airfare booking, travel accommodations, ground transportation, attractions, tourism activities, and overall safety of the travel locations need to be sent to our clients and customers and their families/relatives. 

We may use your personal information to conduct surveys of the services or products purchased and to send you information about the services of our Site.

We may also use personal information for internal purposes such as auditing, data analysis, and research to improve Hello PH!’s products, services, and customer communications. It may also be used for compliance with government submissions and/or reportorial requirements such as with the Anti-Money Laundering Council, Department of Tourism, Department of Trade and Industry including international organizations like the International Policy and the United Nations. 

If you enter into a sweepstake, contest, or similar promotion, we may use the information you provide to administer those programs and contests.

If you apply for a special discount or similar promotion, we may use the information you provide to administer those programs.

If you apply for a position at Hello PH! or we receive your information in connection with a potential role with us, we may use your information to evaluate your candidacy and to contact you. If you are a candidate, you will receive more information about how Hello PH! handles candidate personal information at the time of application.

SOURCE OF YOUR PERSONAL INFORMATION/DATA

We may have received your personal information from other persons if that person has shared their content with you using Hello PH! services and products, sent gift certificates and products, or invited you to participate in Hello PH! services or forums, or you are a party to a group booking or reservation/s. 

If you are a potential candidate for employment with Hello PH!, we may have received your personal information from third parties such as recruiters, headhunters, or external websites. We will use the personal information we receive to contact you about a potential opportunity or in evaluating your candidacy. If you did not provide us your personal information directly, we will inform you of the source when we first contact you regarding your candidacy. 

COLLECTION AND USE OF NON-PERSONAL INFORMATION

We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:

We may collect information such as occupation, language, zip code, area code, unique device identifier, gender identity, referrer URL, location, and the time zone where a Hello PH! product is used or services obtained so that we can better understand customer behavior and improve our products, services, and advertising.

We may collect information regarding customer activities on our website. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our website, products, and services are of most interest. Aggregated data is considered nonpersonal information for the purposes of this privacy policy.

We may collect and store details of how you use our services, including search queries. This information may be used to improve the relevancy of results provided by our services. Except in limited instances to ensure quality of our services over the Internet, such information will not be associated with your IP address.

With your explicit consent, we may collect data about how you use our applications/computer programs in order to help our app developers improve it. Your data may also be used by the smartphone/gadget/computer on which you interact with our app and the said information are eventually shared with us. All information shared with us are protected in accordance with this privacy policy.

If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined and used as combined information.

DISCLOSURE TO THIRD-PARTIES/EXTERNAL ENTITIES

At times Hello PH! may provide third parties with certain personal information to provide or improve our products and services, including to deliver services and products at your request, or to help Hello PH! market to consumers.
